Are You Are Eligible for Social Security Disability Insurance (SSDI)?
Social Security Disability Insurance (SSDI) is a federal program for “insured” individuals who have a disability preventing them from working. SSDI benefits eventually become retirement benefits at full retirement age. To qualify as “insured,” you must have been employed for a specific time and earned taxable income, and your disability must meet the Social Security Administration (SSA) disability standards.
To determine your disability status, the SSA reviews the following factors:
- If you can perform a job at any “substantial gainful activity” (SGA)
- The level of your injury and/or medical condition
- If your medical situation is on the SSA’s list of impairments
- If you can perform the same professional duties as before the disability
- What other type of work you can do
If you can work in a partial capacity but make too much, you will not be eligible for SSDI. If your disability prevents you from returning to your past job, but you can obtain other substantial gainful employment, you may not qualify.
What Is the SSDI Application Process?
You must submit your SSDI application package on the phone with a Social Security agent or via paper. Online applications aren’t available. We recommend that you provide us with all the necessary information and have us prepare the application to ensure everything is completed accurately.
By doing so, we will have a solid foundation to appeal if your application is denied, which is common for first-time filers, even when the application is prepared correctly.
The steps to apply for SSDI are:
- Gather all necessary information and documents for the initial application
- Complete the application and submit it to the SSA
- The SSA reviews your application and supporting documents
- The SSA processes your application and sends it to the Disability Determination Services agency
- The Disability Determination Services agency decides if you are eligible for SSDI
SSDI Benefits and Supplemental Security Income (SSI)
The easiest way to determine how much money you receive with your SSDI benefits is to visit SSA.gov and sign up for a “my social security” account. Once you log in, you will find a variety of documentation about your SSDI benefits, including the money you’ll receive.
Your SSDI benefits can be reduced due to other disability-related payments you already receive, such as long-term disability benefits. It is important to let your lawyer know about other benefits when you prepare your application package.
Besides your SSDI benefits, you may be eligible to apply for a separate federal program for individuals with disabilities: Supplemental Security Income (SSI). SSI fund allocation is needs-based and has its own set of requirements.
To qualify for SSI benefits, you must:
- Be 65 years or older, blind, or disabled
- Have limited income and resources (determined by the SSA based on income and assets)
- Be a US citizen, US national, or a qualifying immigrant
SSI benefits are limited and vary depending on your marital status. Due to the evolution of the cost of living, the SSA re-evaluates and adjusts its funding caps accordingly.
