How Long Do You Have to File a Personal Injury Claim in Michigan?
Like other states, Michigan has a statute of limitations on personal injury lawsuits. The “statute of limitations” is the legal term for the amount of time you have to file your claim, and in Michigan, it is three years. Typically, the “clock” begins ticking, so to speak, on the date of the accident or injury. However, in some cases, the injury is not discovered immediately. When this happens, the statute of limitations begins on the date the injury was discovered or reasonably could have discovered.
What to Do if You Are Injured at Work
If you are injured in a workplace accident or while carrying out any activities related to the scope of your employment, you are likely entitled to workers’ compensation. Workers’ compensation is a no-fault system—meaning you do not need to prove liability to file a claim—that covers nearly all employees in the state of Michigan.

- Notify your employer immediately but no more than 90 days after the injury
