What You Should Know About Michigan’s No-Fault System

Michigan is a no-fault state when it comes to motor vehicle accidents. This means that all motorists must have personal injury protection, or PIP, coverage. As of July 1, 2020, Michigan drivers can choose to purchase unlimited or limited PIP coverage.

Limited PIP coverage is offered in the following standard amounts:

  • $250,000 per person
  • $500,000 per accident

If you are enrolled in Medicaid, you may opt for $50,000/$100,000 in PIP coverage per person/accident and, if you are enrolled in Medicare, you may opt out of PIP coverage entirely.

The purpose of PIP coverage is, ostensibly, to allow accident victims to recover compensation regardless of fault and to have these claims move more quickly through the system. In other words, the idea behind the no-fault system is that injured accident victims can have their claims paid in relatively short amounts of time as opposed to the time associated with filing a traditional car accident lawsuit.

But what happens when PIP coverage is not enough?

In fact, many accident victims find themselves facing medical bills and other losses in excess of their PIP limits. When this happens, it may be possible to step outside the no-fault system and seek compensation by filing a personal injury claim against the at-fault motorist.

To do so, you will typically need to prove the following:

  • The other driver/party breached the implied duty of care by acting negligently or wrongfully
  • The other driver/party’s breach of the duty of care was the cause of your injuries/damages
  • You suffered excess medical damages and/or non-economic damages, such as pain and suffering

Additionally, to recover compensation for non-economic damages, you will need to prove that you were not more at fault than the other driver/party. If you are found to be 50% or more to blame, you cannot recover non-economic damages. However, you may still be able to recover non-economic damages regardless of your degree of fault.
