When to File a Personal Injury Claim
There are several instances in which it may be appropriate to file a personal injury claim. In Michigan, these are also referred to as “third-party claims,” and they are often not the first option when it comes to recovering compensation after an accident. Specifically, the state follows a no-fault car accident system, which means your first step after a motor vehicle collision is typically to file a claim with your own insurance provider and seek compensation through your personal injury protection (PIP) coverage.
However, you may wish to file a personal injury lawsuit after an accident if:
- The cost of your medical bills and other damages exceeds your PIP limits
- You wish to pursue compensation for non-economic damages, like pain and suffering
- Your injuries meet the state’s “serious injury threshold”
- The other driver (or another party) was negligent or acted wrongfully
Additionally, if you were injured in a different type of traumatic event—such as slipping and falling due to unsafe property conditions or receiving substandard medical care—filing a personal injury lawsuit may be your first and best option when it comes to recovering for your damages.
In any case, you only have three years from the date of the accident/injury to file your claim. When an injury or medical condition is not discovered right away, you have three years from the date you discovered your injury or reasonably could have discovered your injury to bring a claim. If you fail to file your personal injury lawsuit within the three-year statute of limitations, your case will almost certainly be thrown out.
