How Long Do You Have To File A Claim In Michigan?

Every state has time limits when it comes to filing personal injury lawsuits. This is known as the “statute of limitations,” and in Michigan, it is three years from the date of the injury. When the injury is not discovered right away, the two-year time limit begins on the date of discovery or the date on which the injury reasonably could have been discovered.

When it comes to filing a workers’ compensation claim, you only have two years from the date of the accident/injury or the date on which you discovered or reasonably could have discovered the work-related injury/illness to file a claim. You should note, however, that you have 90 days to notify your employer of your work-related injury or occupational disease. The 90-day deadline also begins on the date of the injury or the date on which the injury/illness was discovered or reasonably could have been discovered.

Can You Appeal A Denied Social Security Disability Claim?

If your Social Security Disability (SSD) claim was denied, you have the right to request an appeal. In fact, most initial SSD claims are denied – it is nearly always in your best interests to appeal a claim denial rather than file a new claim or simply give up.

Below, we have provided a brief overview of the SSD appeals process:

  • Request for reconsideration: The first step in appealing a denied SSD claim is typically filing a request for reconsideration. The Social Security Administration (SSA) will review the existing evidence, as well as any new evidence, and decide on your case.
  • SSD hearing: The next step in the appeals process is requesting a hearing before an administrative law judge (ALJ). At the hearing, which operates similarly to a trial, the ALJ will hear evidence from both sides and decide on the case.
  • Appeals council review: If you are unhappy with the ALJ’s decision, you can request a review by the Social Security Appeals Council. The Appeals Council may deny your request if it believes the ALJ’s decision was correct.
  • Federal court review: The final step in the appeals process is filing a lawsuit in federal court. This is relatively rare but may be appropriate if you are not happy with the Appeals Council’s review, or if it denies your request for a review.
